1. Scope

These Terms & Conditions apply to the use of the HealthTracker platform, operated by serbizAI, TALLINN. By registering an account, you accept these terms in full.

2. Service Description

HealthTracker is a personal health data organisation and tracking platform that enables users to upload medical reports, track health parameters, log symptoms and medications, and view AI-generated summaries of their own tracked data. The platform does not replace medical advice, diagnosis, or treatment.

HealthTracker does not facilitate medical consultations, telemedicine, or Fernbehandlung (remote medical treatment). The platform does not connect users with physicians or other healthcare professionals. The "Doctor Presentation" feature generates a document summary of the user's own tracked data for the user to bring to their own medical appointments at their own discretion — no medical advice is provided.

3. User Account

Use of the platform requires creating an account.
You are obligated to provide truthful information and to keep your password secure.
You must not transfer your account to third parties or allow third parties to access it.
Each account may only be used by one natural person.

4. Medical Disclaimer and Regulatory Status

Critical Notice: HealthTracker is a personal health data tracking and organisation tool. It is NOT a medical device within the meaning of EU Regulation 2017/745 (MDR), is NOT a certified Digital Health Application (DiGA) under § 139e SGB V, and does NOT provide ärztliche Befundinterpretation (medical findings interpretation) or medical advice under German medical law.

AI-generated summaries organise and display your own tracked data in plain language. They are NOT medical diagnoses, clinical assessments, or treatment recommendations.
No content on this platform replaces a consultation with a qualified physician (Arzt/Ärztin) or other licensed medical professional.
In case of health concerns, symptoms, or abnormal test results, always consult a doctor immediately.
In emergencies, call the European emergency number 112 or the German medical on-call service (ärztlicher Bereitschaftsdienst) at 116 117.

5. User Obligations

The user agrees to:

use the platform for personal, non-commercial purposes only
not to perform automated queries or scraping activities
not to upload content that violates applicable law
protect their own account security and report misuse immediately

6. Limitation of Liability

serbizAI is only liable for damages resulting from intentional or grossly negligent conduct. Liability for indirect damages, loss of profit, or data loss is excluded to the extent permitted by law. The user is solely responsible for the accuracy, completeness, and currency of uploaded medical data.

7. Termination

You may delete your account at any time without giving reasons. serbizAI reserves the right to suspend or delete accounts in case of violations of these Terms or applicable law without prior notice.

8. Governing Law and Jurisdiction

These Terms are governed by the law of Estonia, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

For users acting as consumers, mandatory consumer protection provisions of the user's EU member state of habitual residence apply in addition to — and, where conflicting, instead of — these Terms. Consumers always retain the right to bring proceedings before the courts of their own EU member state of habitual residence, regardless of this clause.

The place of jurisdiction for disputes with merchants, legal entities, and business users is Harju County Court (Harju Maakohus).

Language

These Terms are made available in several languages for your convenience. The English version is the authoritative text. In the event of any discrepancy, ambiguity, or difference of interpretation between the English version and a translation, the English version prevails.

This does not limit any right you may have under mandatory consumer protection law to receive information in the official language of your place of residence.

9. Changes to These Terms

serbizAI reserves the right to amend these Terms. If we make material changes, we will notify you by email at least 30 days before the changes take effect.

You will be required to actively accept the new Terms upon your next login before you can continue using the service. If you do not accept the revised Terms, you may delete your account at any time before the effective date without any additional charge.

Note: Passive continued use of the platform does NOT constitute acceptance of amended Terms under German law (§ 307 BGB).

10. Anonymised Reports and AI Model Training

To improve the accuracy and reliability of HealthTracker's AI-powered parameter extraction, serbizAI may retain anonymised copies of processed medical reports for internal quality assurance and AI model training purposes.

Part of the service, not an option: An anonymised copy is retained for every processed report. These copies are how we verify that the parameter names, measurement units and sample types read from your documents are correct, and how we improve the accuracy of the AI that reads them. Both are what this service does rather than optional extras, so we tell you about them here instead of asking. Only authorised administrators of serbizAI can read them, and they are never shared with third parties, used for advertising, or sold.
The one thing you decide: Whether an anonymised version of your reports may additionally be sent to external AI providers is your choice alone. We ask for it separately, it is off unless you turn it on, and you may withdraw it at any time in your account Settings. Its only purpose is to let more capable AI models read documents our own models struggle with. It is described below and in section 7b of the Privacy Policy.
Anonymisation: Redaction is carried out by an AI model running on our own servers. No report is sent to any external company or shown to any person outside serbizAI for the purpose of anonymising it. The process removes patient names, doctor names, clinical history and identification numbers, contact details, and street addresses, retaining only postal code and country. Exact dates of birth are removed and only the year is kept. Measurements, their units and the dates they relate to are deliberately retained, since those are what make the copies useful.
Anonymisation can fail: Redaction is automated and best-effort. It is performed by an AI model, and a residual risk that identifying information remains within a document cannot be excluded. Where information about you remains in a copy we retain, we do not pass it to any third party, and we work continuously to improve the process. If you have opted in to external AI providers, only an anonymised version of your report is sent to them — never the original. The same residual risk applies to what is sent, and this is the reason that transfer is a separate choice rather than something we do by default.
Encryption: Anonymised files are encrypted at rest with an AES-256 key derived from an administrator password. Only authorised platform administrators can decrypt and access these files. They are never shared with third parties, used for advertising, or sold.
Copies already made cannot be recalled: Anonymised copies contain no link to you or to your reports, so nobody, including us, can determine which of them came from your documents. Deleting your account does not remove them, and neither does withdrawing consent for external providers. This is permanent and cannot be reversed.
No link to you or your reports: Stored copies carry no reference to you, your account, or the report they were made from. There is no identifier linking them back, no filename derived from your data, and no storage location derived from your account. The clinical content of the report is deliberately kept: measurements, their units, and the dates they relate to. This is what makes the copies useful, for example to study how results vary across a population or over time. What is removed is everything that could lead back to a person: your name, your address, your date of birth (only the year is kept), identification numbers, telephone numbers, email addresses and bank details, together with the corresponding details of the doctor, practice or laboratory, since those could otherwise be used to trace a report back to you. Separately, we record the list of medical parameter names and measurement unit names appearing in each copy, so that administrators can review and correct medical terminology. That list contains general medical terms such as "Haemoglobin" or "mg/dL" and no measurements.
Purpose limitation: Stored files are used exclusively for internal AI model training and quality assurance. They will not be used for any other purpose.
Retention: Anonymised copies are retained indefinitely. Because they carry no link to any person, the storage limitation principle in Art. 5(1)(e) GDPR does not apply to them, and there is no legal period after which they must be erased. They cannot be traced to a person and therefore cannot be deleted on request. Withdrawing your consent prevents any further copies being created; see "Consent-based" above. Legal basis: Processing is based on your informed consent (GDPR Art. 6(1)(a) and Art. 9(2)(a) for health data). You have the right to withdraw consent at any time without affecting the lawfulness of processing carried out before withdrawal.
