1. Scope

These Terms & Conditions apply to the use of the HealthTracker platform, operated by serbizAI, TALLINN. By registering an account, you accept these terms in full.

2. Service Description

HealthTracker is a personal health data organisation and tracking platform that enables users to upload medical reports, track health parameters, log symptoms and medications, and view AI-generated summaries of their own tracked data. The platform does not replace medical advice, diagnosis, or treatment.

HealthTracker does not facilitate medical consultations, telemedicine, or Fernbehandlung (remote medical treatment). The platform does not connect users with physicians or other healthcare professionals. The "Doctor Presentation" feature generates a document summary of the user's own tracked data for the user to bring to their own medical appointments at their own discretion — no medical advice is provided.

3. User Account

• Use of the platform requires creating an account.
• You are obligated to provide truthful information and to keep your password secure.
• You must not transfer your account to third parties or allow third parties to access it.
• Each account may only be used by one natural person.

4. Medical Disclaimer and Regulatory Status

• AI-generated summaries organise and display your own tracked data in plain language. They are NOT medical diagnoses, clinical assessments, or treatment recommendations.
• No content on this platform replaces a consultation with a qualified physician (Arzt/Ärztin) or other licensed medical professional.
• In case of health concerns, symptoms, or abnormal test results, always consult a doctor immediately.
• In emergencies, call the European emergency number 112 or the German medical on-call service (ärztlicher Bereitschaftsdienst) at 116 117.

5. User Obligations

The user agrees to:

• use the platform for personal, non-commercial purposes only
• not to perform automated queries or scraping activities
• not to upload content that violates applicable law
• protect their own account security and report misuse immediately

6. Limitation of Liability

serbizAI is only liable for damages resulting from intentional or grossly negligent conduct. Liability for indirect damages, loss of profit, or data loss is excluded to the extent permitted by law. The user is solely responsible for the accuracy, completeness, and currency of uploaded medical data.

7. Termination

You may delete your account at any time without giving reasons. serbizAI reserves the right to suspend or delete accounts in case of violations of these Terms or applicable law without prior notice.

8. Governing Law and Jurisdiction

These Terms are governed by the law of Estonia, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

For users acting as consumers, mandatory consumer protection provisions of the user's EU member state of habitual residence apply in addition to — and, where conflicting, instead of — these Terms. Consumers always retain the right to bring proceedings before the courts of their own EU member state of habitual residence, regardless of this clause.

The place of jurisdiction for disputes with merchants, legal entities, and business users is Harju County Court (Harju Maakohus).

9. Changes to These Terms

serbizAI reserves the right to amend these Terms. If we make material changes, we will notify you by email at least 30 days before the changes take effect.

You will be required to actively accept the new Terms upon your next login before you can continue using the service. If you do not accept the revised Terms, you may delete your account at any time before the effective date without any additional charge.

Note: Passive continued use of the platform does NOT constitute acceptance of amended Terms under German law (§ 307 BGB).

10. Anonymised Reports and AI Model Training

To improve the accuracy and reliability of HealthTracker's AI-powered parameter extraction, serbizAI may retain anonymised copies of processed medical reports for internal quality assurance and AI model training purposes.

• Consent-based: This storage only occurs when you explicitly consent during registration or in your account Settings. You may withdraw consent at any time; withdrawal applies to future reports and does not affect already-stored copies.
• Anonymisation: Before storage, each report undergoes automated redaction of names, dates of birth, addresses, contact details, identification numbers, and other personal identifiers. Anonymisation is best-effort; a small residual risk of identifying information remaining cannot be excluded.
• Encryption: Anonymised files are encrypted at rest with an AES-256 key derived from an administrator password. Only authorised platform administrators can decrypt and access these files. They are never shared with third parties, used for advertising, or sold.
• No personal identifiers in storage metadata: Files are stored without your name, email address, or any other directly identifying information. The only reference retained is a non-sequential report identifier.
• Purpose limitation: Stored files are used exclusively for internal AI model training and quality assurance. They will not be used for any other purpose.
• Retention: Anonymised training files may be retained for up to 5 years or until you request deletion. You may request deletion of your stored files at any time by contacting info@serbizai.com.
• Legal basis: Processing is based on your informed consent (GDPR Art. 6(1)(a) and Art. 9(2)(a) for health data). You have the right to withdraw consent at any time without affecting the lawfulness of processing carried out before withdrawal.
